Referral Programme Terms

1. About the programme

These terms apply to the Enigmatio Ltd Referral Programme. By making or accepting a referral under the programme, the referrer and referred client agree that the referral will be handled in accordance with these terms.

The programme is designed as a thank-you to existing Enigmatio clients who introduce genuine new business to us. It is not an employment, agency, commission or cash-rebate arrangement.

2. Who can make a referral

Unless Enigmatio confirms otherwise in writing, the programme is available to existing Enigmatio clients whose accounts are in good standing.

A referrer must be acting genuinely and must not submit misleading, fabricated or duplicate referrals. You cannot refer yourself or a business that you own or control unless Enigmatio expressly agrees in advance.

3. What counts as a qualifying referral

A referral normally qualifies where all of the following apply:

• the referred person or business is genuinely new to Enigmatio for the relevant project or opportunity;
• the referral is made before, or at the start of, the referred person’s first substantive discussion with us about that project;
• the referred person identifies the referrer, or the referrer submits the referral through our referral process;
• the referred client accepts an eligible paid project or scope of work with Enigmatio;
• the project is completed or reaches the qualifying point confirmed by Enigmatio; and
• all amounts due for the qualifying project have been paid in full and cleared.

If the referred business was already an active Enigmatio lead or was already discussing the same project with us before the referral, the programme will normally not apply.

4. New client discount

The referred new client receives a discount equal to 10% of the qualifying project value, up to a maximum discount of £100.

Unless we state otherwise in writing, the discount applies to the first qualifying project only. The discount cannot be exchanged for cash or applied retrospectively to work already invoiced or paid.

Referral discounts cannot normally be combined with another promotion or discount unless Enigmatio agrees in writing.

5. Referrer reward

Once the qualifying project has been completed and paid for in full, the referrer will receive an Enigmatio gift card equal to 10% of the qualifying project value, capped at £100.

The reward is a credit for future Enigmatio services. It is not a cash payment, commission or cash-equivalent withdrawal.

6. How the qualifying project value is calculated

Unless we confirm a different calculation in writing, the qualifying project value is the agreed Enigmatio service fee for the first qualifying project before the referral discount is applied.

The calculation excludes amounts that are not Enigmatio service fees, such as:

• VAT or other taxes where applicable;
• advertising or media spend paid to platforms such as Google or Meta;
• domain registration fees and third-party licence charges;
• stock assets, printing, postage, travel or other third-party/pass-through costs;
• refunded, credited, cancelled or unpaid amounts; and
• renewals or recurring charges unless Enigmatio specifically confirms that they form part of the qualifying value.

For retainers, subscriptions or other recurring services, Enigmatio will confirm in writing whether the arrangement qualifies and what amount is used to calculate the referral benefit.

7. Gift card validity and use

Referral gift cards:

• are valid for six calendar months from the date they are issued;
• can be used towards eligible services supplied by Enigmatio;
• cannot be exchanged or redeemed for cash;
• cannot be used to pay third-party costs, advertising/media spend or other pass-through charges unless Enigmatio agrees otherwise;
• cannot be applied retrospectively to an invoice that was already paid before the gift card was issued; and
• expire automatically at the end of the six-month validity period, including any unused balance.

If you have more than one Enigmatio gift card, contact us before placing your next order. Combining multiple gift cards on one invoice is subject to Enigmatio’s written agreement.

8. If more than one person made the referral

If two or more people genuinely recommended Enigmatio to the same new client, the new client may tell us which person should be recognised as the referrer.

Alternatively, the new client may ask us to divide the available referrer reward between the people who contributed to the referral. The total reward available for that qualifying referral will not exceed the normal programme cap of £100.

For example, if two referrers are recognised equally and the referral qualifies for the maximum £100 reward, each referrer would receive a £50 Enigmatio gift card. The referred client’s own discount is not increased or multiplied because there is more than one referrer.

9. Multiple referrals

An eligible client may make more than one referral. Each qualifying new client and project is assessed separately under the programme rules.

10. Cancellations, refunds and unpaid projects

A referral reward is not earned until the qualifying project has met the conditions in these terms and all relevant amounts have been paid in full.

If a project is cancelled, refunded, charged back, materially reduced or remains unpaid, Enigmatio may reduce, withhold or cancel the associated referral reward. If a reward was issued in error before a payment was reversed, we may cancel any unused gift-card balance or adjust a future credit where reasonably necessary.

11. Referral details and permission to make contact

If you submit another person’s contact details to us, you must make sure they are happy for you to share those details with Enigmatio and for us to contact them about the referral.

We will use referral information in accordance with our Privacy Policy. A referred person is not automatically subscribed to our marketing emails.

12. Misuse of the programme

We may refuse, suspend or cancel a referral benefit where we reasonably believe there has been fraud, manipulation, misleading information, duplicate claims, abuse of the programme or an attempt to obtain benefits contrary to the purpose of the scheme.

13. Changes to or withdrawal of the programme

Enigmatio may change, pause or withdraw the referral programme in the future. We will not normally apply a later adverse change to a referral that we had already confirmed as eligible before the change took effect.

We may update these terms from time to time. The current version and latest update date will be published on our website.

14. Our responsibility

Nothing in these terms excludes or limits liability where it would be unlawful to do so. Subject to any rights that cannot legally be excluded, Enigmatio is not responsible for indirect or consequential loss arising solely from participation in the referral programme.

15. Governing law

These Referral Programme Terms are governed by the law of Scotland, subject to any mandatory rights that apply to an individual under applicable consumer law. The Scottish courts will have jurisdiction where legally permitted.
